This Agreement is between Regulator Logistics ("Owner"), Williston, North Dakota, and the person or business renting a trailer ("Renter"). By typing your full name and checking the agreement box, you confirm you have read, understood, and agree to these terms.
1. Rental Period & Rates. The trailer is rented for the dates selected at the daily rate shown at booking. The period begins when the trailer leaves our yard (or is delivered) and ends when it is returned in the agreed condition.
2. Security Deposit. A refundable deposit is collected with each rental and returned after the trailer is inspected and confirmed free of damage beyond normal wear, with no outstanding charges. Damage, cleaning, or late fees may be deducted; amounts exceeding the deposit remain the Renter's responsibility.
3. Payment. Accepted by card, cash, or check. Charges may include the rental total, deposit, delivery, and any damage, cleaning, or late fees. All payments are recorded for your receipt.
4. Eligibility & Towing. You must be 18+ with a valid license and must provide a tow vehicle, hitch, safety chains, and lighting rated to safely and legally tow the loaded trailer. Confirming your equipment is adequate is your responsibility.
5. Condition Documentation. The trailer is photographed at pickup and return with a timestamp. These records are the shared reference for any damage question. Review pickup photos and raise concerns before towing.
6. Use & Load Limits. Do not exceed rated payload/gross weight; secure and distribute loads lawfully; use the trailer only for lawful purposes consistent with its design; comply with all transport and load-securement laws.
7. Prohibited Uses. No overloading; no hazardous, illegal, or improperly secured materials; no subletting or transfer to others; no off-road use beyond design; no removing safety equipment. Prohibited use voids the rental.
8. Damage, Loss & Theft. You are responsible for the trailer from pickup to return, including damage beyond normal wear, loss, theft, or damage from improper loading, overloading, or unsafe towing. Report any damage or theft promptly; repair/replacement costs are the Renter's responsibility.
9. Insurance. Towing is at your risk. Your vehicle insurance and any liability coverage are primary for towing and for cargo. We do not insure your load or towing operation.
10. Liability & Indemnification. You assume responsibility for safe, legal towing and load securement. To the fullest extent permitted by law, you agree to hold harmless and indemnify Regulator Logistics against claims, citations, injuries, or damages arising from your use, except those caused by our gross negligence. Our liability is limited to amounts paid for the rental.
11. Late Return. Late returns are billed at the applicable daily rate for each additional day until the trailer is returned, and may affect deposit return.
12. Cancellation. Cancel up to 48 hours before pickup at no charge. Cancellations within 48 hours of pickup are charged one day's rental rate. No rental payment is charged until pickup is confirmed. No-shows may forfeit prepaid amounts.
13. Dispute Resolution. Damage or charge disputes are reviewed against the timestamped pickup/return photos and the payment record, and resolved in good faith based on that documentation.
14. Governing Law. This Agreement is governed by the laws of the State of North Dakota and subject to the jurisdiction of North Dakota courts.
15. Electronic Signature. By typing your full legal name and checking the box, you acknowledge you have read and agree to these terms, and that your typed name is a legally binding electronic signature. Your acceptance and the terms version are recorded for both parties.
16. Entire Agreement. These terms are the entire agreement for the rental. If any provision is unenforceable, the rest remain in effect.
